Basically it'll be enforcing a law that has never been enforced anyway. Lots of money spent to make a duplicate state law lol. I'm sure Cali threw some other stuff in there also. And I'm willing to bet to get that stamp you have to have your exhaust tested on the bike it goes one and I'm also willing to bet the feds ain't providing the bike so if a manufacture wants to get that stamp be prepared to pay WAY more than you pay now.

It's been a Federal Law for quite a long time now that you can't modify your exhaust.

§ 205.169 Labeling requirements.

(a) The manufacturer of any product (including the manufacturer of newly produced motorcycles) subject to this subpart must, at the time of manufacture, affix a permanent, legible label, or mark of the type and in the manner described below, containing the information provided below, to all such exhaust systems or exhaust system components to be distributed in commerce.

( B) The labels or marks shall be affixed in such a manner that they cannot be removed without destroying or defacing them, and must not be applied to any part which is easily detached from such product.

© The label or mark shall be in a readily visible position when the exhaust system or exhaust system component is installed on all motorcycles for which it is designed and marketed.

(d) All required language shall be lettered in the English language in block letters and numerals in a color that contrasts with its background.

(e) The label or mark must contain the following information:

(1) For exhaust systems subject to the noise emission standards of §205.166:

(i) The label heading: Motorcycle Exhaust System Noise Emission Control Information;

(ii)(A) For original equipment and replacement exhaust system, the following statement:

This (manufacturer's name) exhaust system (serial number) meets EPA noise emission requirements of (noise emission standard) dBA for the following motorcycles: (list of model specific codes). Installation of this exhaust system on motorcycle models not specified may violate Federal law.

( B) For exhaust system components designed and marketed for motorcycles, and tested in accordance with §205.168 as a constituent of a complete exhaust system comprising non-original equipment components (other than itself), as provided for in §205.166( B) (3), the following statement:

This (manufacturer's name) (type of component) (serial number), when installed with a legal (type of component), meets EPA noise emission requirements of (noise emission standard) dBA for the following motorcycles: (list of model specific codes). Installation of this exhaust system components on motorcycle models not specified may violate Federal law.

(iii) The model specific code must be the same as used by the motorcycle manufacturer and described in §205.158(a)(6).

(2) For exhaust systems designed solely for use on competition motorcycles (as defined by §205.151(a)(3) and so designated and labeled by the manufacturer), the statement:

This product is designed for use on closed course competition motorcycles only and does not conform to U.S. EPA noise emission standards. Used on motorcycles subject to EPA noise regulations constitutes tampering and is a violation of Federal law unless it can be shown that such use does not cause the motorcycle to exceed applicable Federal standards.

(3) For exhaust systems designed solely for use on motorcyles manufactured before January 1, 1982, the statement:

This product is designed for use on pre-1982 model year motorcycles only and does not conform to U.S. EPA noise emission standards. Use on motorcycles subject to EPA noise regulations constitutes tampering and is a violation of Federal law unless it can be shown that such use does not cause the motorcycle to exceed applicable Federal standards.

(4) For replacement exhaust systems manufactured in the United States solely for use outside the U.S. and not conforming to the noise emissions standards of this regulation, the statement: “For Export Only.”

So unless you have a bike manufactured before 1982 then you should be running around with basically a factory exhaust because I've never seen an aftermarket exhaust that carries that required tag. There's a reason they all say "for off road use only" or something along those lines.
So the states are thinking of wasting money to make another law that is basically the same as the law that was never enforced before.........................your tax money at work.

We all have been party to the V-twin experience. The loud pipes tribe is driving this and it will give enforcement opportunity to add a citation to any bike that has modified exhaust.....that is manufactured after 2013.

What a toothless, feel good piece of legislation. This will likely cut into the sales of 2013 models and increase the value of used bikes with modified exhaust.

Someone didn't think this through or they would have mandated it start immediately and put teeth into the enforcement by using db meters like the proposal published by the AMA and in use in jurisdictions across the country.

Oh well....this legislation was bound to eventually pass, California first then the rest of the states like dominoes. The loud pipe crowd have had their say and now we will all live with the result. Only time will tell if enforcement agencies will modify their bikes to OEM standards and lead by example. :dntknw:

We are definitely experiencing that issue here in Denver. The "burbs" are still pretty much avoiding it so far. I like a good sounding exhaust system but some are rediculously loud.I definitely don't like the big brother laws though. Seems like that is today's trend to fix a problem!

 
I'm the weird ass FJR owner who posted a topic awhile back regarding aftermkt exhausts. I explained how I was looking for exhausts that sound like a V-8, I was looking for more noise not less, I too hate the unbaffled harley crowd brapping up and down crenshaw blvd and the 105. Thats way too effing loud and probably warps valves. My new TBR M-5's with the P-1 tips(in Blue), create the exhaust note that makes me heard weather i am at hwy speeds or lane sharing. I periodically work on a road glide that belongs to Anthony Keidis(RHCP), and also work on Vespas for Rick Rubin and Owen Wilson, They all asked about the new "Electric" bike, The Vectrix, because of noise, The Vectrix is 100% quiet, Too Quiet for safety. I would need an exhaust soundtrack with giant speakers to feel safe on that. AK's harley has stock exhausts and is loud enough cruising through Malibu, I put Sito Exhausts on Ricks bikes about 4 Years ago for extra power and a little more sound since its so hard to spot a tiny scooter (150cc), until its too late. I agree to have noise level maximums but I hope we dont get thrown into the mix by virtue of the noisy harleys. My TBR M-5's have no percussion, are not obnoxiously loud and create additional presence IMHO. Hopefully I wont go overboard and install ground effects lighting for visual presence. :p dr

Your post indicates your immediate reaction without understanding what is being said by others.

The point has nothing to do with the particular sound one enjoys from their motorcycle. For example, I have a pair of Holeshot mufflers that are sometimes on my bike but not on longer trips (4-14 days) where I prefer to enjoy the scenery and the music from my XM radio.

The issue has everything to do with those who insist on running unbaffled/unmuffled exhaust or loud aftermarket mufflers AND who insist on their right to exhibit that noise in densely populated or high traffic areas where other citizens would rather enjoy their shopping, dining or scenery experiences.

When those two "rights" or "freedoms" collide, one of the parties could restrict or control their "freedom" or "right" to allow the assaulted party to exercise their freedom unimpeded or unassaulted by the other.

That isn't the case, and you know it. Since there are more non-motorcyclists who are offended and they report the particular issue-at-hand to their local constabulary who does not enforce certain noise limit laws, they are left with little recourse but to work their way up the legislative ladder until they reach an elected official who will listen and respond to their complaint. It's purely a numbers game multiplied by the egregious and offensive behavior of some who exercise their freedom at the expense of other's peace.

That's all I meant. I don't care for being awakened from my sleep because a group or motorcyclists leave an "entertainment" facility 2 blocks from my home at 0200 closing time and decide to exercise their right to make excessive noise. My choice is to by offended but roll over and go back to sleep. Other citizens, particularly those with very young children, believe they have the right to sleep peacefully through the night and not deal with their children who have been awakened. Others believe they should be able to dine alfresco at a restaurant and hold a conversation without being interrupted by a "tribe" of loud motorcycles (2-cylinder and 4 cylinder) who refuse to idle through restaurant districts. When the patrons will not longer visit establishments, business owners will voice their complaints to local and state governments and those governments will respond to the electorate.

THAT is the basis for my statement in my post above. The motorcycle community is bringing this upon themselves when it could have been ameliorated rather than legislated.

Choices carry responsibilities and have consequences.

I have been fighting this for months. Sending letters to my representatives here in California every month. I am sadden that some comments here indicate that it is okay to take more and more freedoms of choice away. Loud exhaust is not that bad here and I ride at least 100 miles a day 7 days a week. Some bikes are a little loud but almost everyday I have someone in a cage try and take me out by not looking when changing lanes. I want louder pipes.
I fucking hate the straight pipe cruiser crowd. I fucking hate really loud pipes. They are obnoxious and piss everybody around them off - except for the asswipe riding the bike who thinks he's O so cool.

does anyone really believe an open piped motorcycle (harley or otherwise) is not ALREADY in violation of noise ordinances already on the books in virtually every municipality?

personally I'm tired of hearing unmuffled V-twins from blocks away and would welcome action by the LEO's. I can't understand why they continue to allow the obnoxious noise makers.

If the LEOs won't enforce, yet the populous wants enforcement, what options are you left with?

Pretty much the only option left here was killing the problem via legislation. Nothing really brain dead about that.

It sucks for those of us who are responsible.

IMO - LEOs don't enforce it because many aspire to be (or are already part of) the problem. Anyhow, time is apparently better spent writing 5mph over tickets via a speed trap - you know, the real problem on our roadways.

It seems like they have multiple avenues toy get you here. decibel level and catalytic converters. This should be interesting proving you do or don't have a CC... Lets see how this is enforced in the real world and not in the legislative world.

I thought about this and realized that while the offensively loud bikes I hear nearby are most always Harleys, the majority of bikes I hear from a distance are almost equally weighted in favor of sport bikes! I'm a few blocks off a freeway that has a slight rise a good mile from my house. Evenings, I often hear some kid winding his liter-type sport bike to to 8 or 9 or 10K RPMs as he takes that hill. I don't think I've EVER heard a Harley from that distance. (Seldom see them lane splitting at 40 or 50 over, either. Can't, I suppose.)

You should have gone on with your quote. That wasn't the only motorcycle-related thing there. The article also contained this: "Another measure signed by the governor extends to 2016 an exemption that allows the importation of kangaroo body parts, which are used to make soccer shoes and other apparel. The measure, SB 1345, is by Sen. Ron Calderon (D-Montebello)." Now I can get those KANGAROO RIDING GLOVES! :)
